Employers Should Provide a Safe Working Environment

Employers are supposed to provide a safe working environment for the well being of their employees. Injuries in manufacturing, production, warehouse, and factory work are common because of the inherent dangers associated with the job.

Ohio Workers’ Compensation

A Workers’ Compensation claim can be asserted if you are injured in the course and scope of your employment. An employee should report a work injury as soon as it occurs and follow all proper reporting requirements set forth by the employer. Failure to do so could jeopardize your claim. 

The Ohio Bureau of Workers’ Compensation has a standardized form for reporting work injuries called a First Report of an Injury, Occupational Disease or Death (FROI)

Employer Intentional Tort

Workers’ Compensation is almost always your sole remedy at law if you are injured on the job. There is a narrow exception that applies when an employer removes a safety guard. If you are injured because a safety guard was disconnected, removed, or altered, then you may also assert an employer intentional tort claim in addition to a Workers’ Compensation claim. Additional damages are recoverable under an intentional tort claim like pain and suffering, which is not available under the Workers’ Compensation framework.  

Injured While Traveling for Work

Many people travel for their jobs. Going from one place to another is something you may do only occasionally or every day. If you are injured while traveling for your job, you have the right to make a personal injury claim against the third party in addition to a Workers’ Compensation claim.
